SHOULD I FILE FOR BANKRUPTCY BEFORE THE HOLIDAY SEASON?

If you have been struggling with your bills, you might have thought about hiring a bankruptcy attorney to help you file for bankruptcy. Although doing so isn't a decision that you should take lightly, it may be the ticket to starting over with a fresh financial start.

With the holidays around the corner, being proactive about managing your finances may be just what you need instead of digging yourself deeper in debt by charging up those credit cards while holiday shopping.

Here are a few reasons why you may want to consider filing before the holidays:

Avoid Embarrassing Collection Calls:

The last thing that you probably want to deal with while hosting holiday guests is for bill collectors to call. Plus, dealing with constant collections calls when you're trying to prepare for and enjoy the holidays can be a major downer. Luckily, you won't have to worry about collections calls once you file for bankruptcy. As soon as you file for bankruptcy, your creditors receive a notice that you have filed and all attempts to collect a debt must stop.

Avoid Racking Up More Debt:

If you don't take the right steps now, you might continue down the same path of racking up more debt. If you go ahead and file bankruptcy now, you won't be tempted to use your credit cards to fund holiday gifts. Plus, you won't have to worry about using your credit cards and filing for bankruptcy after the holidays, when it could be believed that you did so for fraudulent reasons. As a matter of fact, larger "luxury" purchases on credit within 90 days of filing can hurt your case.

Start the New Year Out Right:

Wouldn't you love to start out the new year without this big financial cloud floating over your head? Filing for bankruptcy now can help you do just that so that you can set new financial resolutions for the new year. Bankruptcy can give you a clean slate to go into the new year. Now that is a resolution worth sticking to.

Take a Look at Your Budget Now:

We know budgeting isn't exactly at the top of everyone's list of things they want to do. But while you may not want to budget, now is a better time than ever. With Halloween around the corner, you may be considering spending money on a costume, decorations, and candy. All of these expenses add up. Do you have room in your budget? You also need to take into consideration the holiday season ahead.
